Singapore: BSI Bank to be shut down due to ‘gross misconduct’ amid 1MDB scandal

THE Money Authority of Singapore (MAS) will be shutting down BSI Bank for a series of grave offences, and has referred six members of staff to the Public Prosecutor to determine if they have committed crimes.

MAS announced in a statement on Tuesday that it served BSI Bank a notice of intention to withdraw its status as a merchant bank in Singapore.

The notice contains “serious breaches of anti-money laundering requirements, poor management oversight of bank’s operations, and gross misconduct by some of the bank’s staff”.

The announcement comes as Swiss financial regulators opened criminal proceedings against the bank in connection to allegations of corruption against controversial Malaysian state fund 1MDB.

According to BBC, Switzerland’s Office of the Attorney General (OAG) said it obtained information suggesting BSI could have prevented “the offences of money laundering and bribery of foreign public officials currently under investigations in the context of 1MDB”.

BSI Bank, owned by BSI Ltd in Switzerland, said in a statement that it would cooperate with the Swiss attorney-general, describing the case as “legacy issues and removing uncertainty for clients and staff in relation to 1MDB”.

The decision to shut down the bank is based on three investigations made from 2011 to 2015, in which the regulator uncovered “multiple breaches” and a “pervasive pattern of non-compliance” within BSI.

MAS has also imposed financial penalties on BSI totaling about US$9.6m (SG$13.3m) for 41 breaches of MAS Notice 1014, Prevention of Money Laundering and Countering the Financing of Terrorism.

The six members referred to the Public Prosecutor include people from BSI’s senior management and staff. They are:

  • Former CEO, Hans Peter Brunner
  • Former deputy CEO, Raj Sriram
  • Head of Wealth Management Services, Kevin Michael Swampillai, who is currently suspended
  • Former senior private banker, Yak Yew Chee
  • Former wealth planner, Yeo Jiawei, who has been charged for “various offences”
  • Former senior private banker, Yvonne Seah Yew Foong

MAS’ managing director Ravi Menon said in the statement: “BSI Bank is the worst case of control lapses and gross misconduct that we have seen in the Singapore financial sector. It is a stark reminder to all financial institutions to take their anti-money laundering responsibilities seriously.

“Controls need to be robust, surveillance vigilant, and the management culture must emphasize professional integrity and risk consciousness.”

Pakistan militant 'leader' killed in Indian Kashmir

SRINAGAR, India – A suspected leader of the Pakistani militant group Jaish-e-Mohammad and another suspected militant have been killed in a shootout with security forces in Indian Kashmir, police said Tuesday.

The clash happened in the regional capital Srinagar late Monday, hours after rebels shot dead three policemen in separate attacks in the city.

Deadly attacks on security forces are relatively common in the disputed Indian-controlled Himalayan region, but Srinagar has been largely free from such incidents in recent years.

“Two militants, including a JeM (Jaish-e-Mohammad) commander, were killed after a brief encounter,” Srinagar police chief Amit Kuma told reporters.

Another senior officer, Ghulam Hassan Bhat, told AFP that police had launched an operation against the men after receiving intelligence they were hiding out in the city.

Bhat identified one of the dead as Saifullah, a Pakistani national and senior leader of JeM, one of the groups India blames for a 2001 attack on its parliament.

The operation was apparently not related to the two attacks earlier in the day by gunmen on motorbikes in which three police officers were killed in the heavily militarised city.

Kashmir has been divided between India and Pakistan since the end of British colonial rule in 1947. Both claim the territory in its entirety.

An insurgency to end Indian rule in the mainly Muslim region broke out in 1989 and has killed tens of thousands of people, many of them civilians.

India blames Pakistan for backing the militants in Kashmir, a charge Islamabad denies.

MAS to shut down BSI Bank in Singapore for alleged money laundering

The Monetary Authority of Singapore (MAS) announced in a statement on Tuesday (May 24) that it has served BSI Bank Limited (BSI Bank) notice of intention to withdraw its status as a merchant bank in Singapore for serious breaches of anti-money laundering requirements, poor management oversight of the bank’s operations and gross misconduct by some of the bank’s staff.

BSI Bank has been operating as a merchant bank in Singapore since November 2005, offering private banking services. It is a wholly-owned subsidiary of BSI SA, a bank founded in 1873 and headquartered in Switzerland.

This is the first time that MAS is withdrawing its approval for a merchant bank since 1984, when Jardine Fleming (Singapore) Pte Ltd was shut down for serious lapses in its advisory work.

The Swiss bank is also embroiled in global probes into Malaysian state fund 1Malaysia Development Bhd (1MDB).

MAS said it is working closely with the Swiss Financial Market Supervisory Authority (FINMA), the home regulator of BSI SA, to oversee an orderly closure of BSI Bank in Singapore. Clients and customers of BSI Bank are assured that it is solvent and has assets in excess of its liabilities and commitments. It also has the full support of its parent bank, BSI SA in Switzerland.

Back in 2011, MAS inspected BSI Bank and found policy and process lapses at its front office and weak enforcement by control functions. These lapses were rectified but MAS inspected the bank again in 2014 and uncovered serious issues in its due diligence checks on assets underlying the investment funds structured for the bank’s customers.

Following this, MAS instructed BSI Bank’s management to increase scrutiny of the bank’s risk management processes and internal controls. In 2015, MAS conducted a more intrusive third inspection which then revealed multiple breaches of anti-money laundering regulations and a pervasive pattern of non-compliance.

Specific regulatory lapses by BSI Bank included the processing of multiple unusual transactions which were essentially pass-through trades often without economic substance.

Approvals of such transactions were based purely on faith of client representations despite deficient documentation and concerns raised by the bank’s compliance officers.

FINMA has approved the acquisition of the entire BSI Group by EFG International, a bank authorised by FINMA and based in Switzerland, MAS said.

In the interest of BSI Bank customers, MAS will allow the transfer of the Singapore subsidiary’s assets and liabilities to the Singapore branch of EFG Bank AG or to the parent entity, BSI SA.

The Authority found considerable evidence of gross dereliction of duty and failure to discharge oversight responsibilities on the part of BSI Bank’s senior management. Its ineffective leadership led to a poor risk culture, which prioritised questionable customer demands ahead of compliance with anti-money laundering regulations and the bank’s own internal controls.

Several of the bank staff had also committed acts of misconduct such as making material misrepresentations to auditors, abetting improper valuations of assets and taking instructions from persons other than customers’ authorised representatives on matters relating to their accounts.

The severe lapses and failings in BSI Bank were the result of the actions or omissions of these individuals.

MAS has also referred to the public prosecutor the names of six members of BSI Bank’s senior management and staff to evaluate whether they have committed criminal offences.

They are: Former chief executive Hans Peter Brunner; former deputy chief executive Raj Sriram; head of wealth management services Kevin Michael Swampillai (who is suspended by the bank); former senior private banker Yak Yew Chee; former wealth planner Yeo Jiawei; and former senior private banker Seah Yew Foong Yvonne.

Additionally, MAS has also served BSI Bank notice to impose financial penalties amounting to $13.3 million for a total of 41 breaches of MAS Notice 1014 – Prevention of Money Laundering and Countering the Financing of Terrorism. These breaches include failure to perform enhanced customer due diligence on high risk accounts and to monitor for suspicious customer transactions on an ongoing basis.

MAS managing director Ravi Menon said: “BSI Bank is the worst case of control lapses and gross misconduct that we have seen in the Singapore financial sector. It is a stark reminder to all financial institutions to take their anti-money laundering responsibilities seriously.”

Financial institutions in Singapore are required to comply strictly with the Authority’s regulations on anti-money laundering and countering the financing of terrorism.

MAS is conducting supervisory reviews of several other financial institutions and bank accounts through which suspicious and unusual transactions have taken place.

Philippines' Duterte launches vulgar attacks on Church

PHILIPPINES – Explosive incoming Philippine president Rodrigo Duterte has launched a series of obscenity-filled attacks on the Catholic Church, branding local bishops corrupt “sons of whores” who are to be blamed for the nation’s fast-growing population.

Duterte also warned the Church, which has a centuries-old tradition of influencing Philippine politics, that his landslide election win this month showed he had more power than its leaders and he would defy them by dramatically expanding family planning.

“Don’t f**k with me,” Duterte told senior church figures who had criticised him, delivering his message via reporters at a press conference in his hometown of Davao on Monday night.

Duterte defied conventional political wisdom with his huge win in the presidential elections, after an incendiary campaign that saw his popularity surge on threats to kill tens of thousands of criminals and vulgar tirades against establishment figures.

Duterte last year called Pope Francis a “son of a whore” for causing traffic jams when he visited Manila, a bold tactic in a nation where 80 percent of the population are Catholics.

Just before the election, the Catholic Bishops Conference of the Philippines released a letter advising Filipinos not to vote for a “morally reprehensible” candidate.

The letter did not name Duterte, but it was widely assumed to have been directed at him. Duterte indeed this week said he was the target.

“It is time to be clear between us. You have been castigating me, criticising me,” he said at a press conference on Sunday in his first post-election tirade against Church leaders.

Duterte then described Filipino bishops as “sons of wh**es”, as he accused them of being corrupt hypocrites and vowed to expose their “sins”.

Duterte, who admits to serial Viagra-fuelled adultery against his current partner after having his first marriage annulled, also blamed the Church for the nation’s rapid population growth.

The Church has opposed the government giving out contraceptives and teaching family planning.

While a law was passed in 2012 allowing the government to provide contraceptives, Church lobbying helped influence politicians to cut funding for the programme.

Duterte vowed to dramatically expand the programme after he takes office on June 30, stating he wanted families to have a maximum of three children.

He has four children to two mothers.

Duterte has set himself up for confrontation with the Church on another key front, promising to bring back the death penalty.

The Church will not back down against Duterte on such core issues, one of its leaders, retired archbishop Oscar Cruz, said on Tuesday.

“We won’t be quiet… the Church will preach what it thinks is right,” Cruz said on DZBB radio.
